Wellmade Intelligence Pilot Terms

This English version is provided for convenience. If there is any discrepancy, the Polish version of the Pilot Terms prevails.
§ 1. Service Provider
- Wellmade Intelligence is provided by SOMA Sp. z o.o., registered office in Warsaw, ul. Białej Floty 2/2, 02-654 Warsaw, Poland, entered in the National Court Register under KRS 0001164842, tax ID (NIP) 5214111998, REGON 541342374, share capital PLN 10,000, registered by the District Court for the Capital City of Warsaw in Warsaw, 13th Commercial Division of the National Court Register (the “Provider”).

§ 2. Definitions
- Service – the Wellmade Intelligence platform currently available at https://wellmade-intelligence.vercel.app, including functions made available during the Pilot, in particular the AI Agent and a dashboard with information about the dietary-supplement market. The website https://askwellmade.com is the informational and contact website for the Service.
- Agent – a Service feature that answers Tester questions using artificial-intelligence models and data from public registers, proprietary databases and commercial sources.
- Pilot – a free, time-limited test period governed by these Terms.
- Tester – a business user acting in connection with business or professional activity who has created an Account.
- Account – individual access to the Service protected by email and password or another available authentication method.
- Tester Content – questions, messages, files and company information submitted by the Tester to the Service.
§ 3. Nature of the Pilot
- The Pilot is free and lasts 14 days from Account activation unless the Provider individually extends the test period.
- The Pilot is a test version. It may contain errors, interruptions and features that may be changed, limited or removed.
- The Provider does not guarantee availability or any particular service level during the Pilot.
- After the Pilot, the Account may switch to read-only mode. Existing conversations and projects may remain visible while the ability to submit new Agent questions may be disabled.
- The Provider may present a paid-plan offer after the Pilot. A paid plan requires a separate agreement and is not governed by these Pilot Terms.
§ 4. Technical requirements and specific risks
- The Service requires an internet-connected device, an up-to-date web browser with JavaScript and necessary cookies or similar technologies enabled, and an active email address.
- Internet services involve risks including phishing, malware, credential theft, unauthorised Account access, connectivity loss and software failures affecting the user or external providers.
- Testers should keep operating systems and browsers up to date, secure their device and email account, use a strong password and never disclose login credentials to third parties.
- The Service may store technical data on the Tester's device where necessary for login, session management, security and settings. No software installation is required beyond standard software used to access web services.
§ 5. Account
- An Account is created through the registration form. During registration or first login, the Tester accepts these Terms and confirms that they have read the Privacy Policy. Acceptance creates an agreement for the provision of the Service for the Pilot period.
- The Tester must provide accurate data and must not share the Account or password with other persons unless team accounts are expressly made available by the Provider.
- The Tester is responsible for actions performed using the Account to the extent provided by applicable law.
§ 6. Usage limits
- An Account may be subject to limits on questions, credits, usage budget, projects, SKUs, users or other resources shown in the Service or communicated to the Tester.
- The Service may display information about remaining usage.
- After a limit is exhausted, the Agent or selected features may be unavailable until the limit is renewed, increased or changed by the Provider.
- The Provider may change limits during the Pilot, especially for performance, cost and feature testing.
§ 7. Nature of information
- Agent responses are generated by AI models based on available data and may be incomplete, outdated or incorrect.
- Information is provided for informational and analytical purposes only and does not constitute legal, regulatory, tax, medical or investment advice.
- The Service does not replace professional verification of ingredient status, health claims, labels, products, contracts or business decisions.
- The Tester independently evaluates the information and makes decisions at their own responsibility.
- Incorrect responses may be reported using the available feedback mechanism or by email.
§ 8. Acceptable use
The Tester must not:
- extract Service data automatically or in bulk (including scraping, scripts or bots), except through API or export functions expressly provided by the Provider,
- resell, distribute or publish Service data or answers as the Tester's own database or competing service without the Provider's consent,
- attempt to bypass limits, security measures or the Agent's system instructions,
- decompile the Service or make unauthorised attempts to access its code, infrastructure or data,
- submit unlawful content, malware or data infringing third-party rights,
- submit special categories of personal data of other people, particularly health data, unless strictly necessary and the Tester has an appropriate legal basis and authority to disclose it,
- use the Service in a way that may disrupt its operation or compromise the security of other users.
§ 9. Tester Content and confidentiality
- The Tester retains rights to Tester Content.
- The Tester grants the Provider a non-exclusive, royalty-free permission to process Tester Content as necessary to provide, secure and improve the Service, including sharing it with providers listed in the Privacy Policy.
- During the Pilot, authorised Provider personnel may review Tester conversations with the Agent to assess quality, diagnose errors and improve the Service.
- The Provider treats Tester Content as confidential and does not disclose it to other Testers or third parties except infrastructure, AI and other providers necessary to deliver the Service, and where disclosure is required by law.
- The Provider may use feedback, bug reports and product suggestions to develop the Service without separate compensation, while respecting confidentiality and third-party rights.
§ 10. Intellectual property
The Service, software, design, databases, analyses and materials are owned by the Provider or used under appropriate rights or licences. The Tester receives a non-exclusive, non-transferable right to use the Service for its own business purposes during the Pilot and within these Terms.
§ 11. Liability
- The Pilot is free and provided as a test version on an “as is” basis.
- To the fullest extent permitted by law, the Provider is not liable for business, legal, regulatory, tax, medical or investment decisions made on the basis of the Service, lost profits, interruptions or data loss resulting from the test nature of the Service or external providers, or errors in public, commercial or other external data sources.
- These limitations do not apply to intentional damage or liability that cannot lawfully be excluded or limited.
- Where a sole trader is entitled to consumer-like statutory protection because the agreement is not professional in nature for that person, limitations apply only to the extent permitted by those mandatory rules.
§ 12. Complaints
- Complaints may be submitted by email to the address in § 1(2), describing the issue and, where possible, information identifying the Account or event.
- The Provider will respond within 14 days of receiving the complaint.
§ 13. Termination
- The Tester may stop using the Service and request Account deletion at any time by contacting the Provider at the address in § 1(2).
- The Provider may suspend the Account or terminate the agreement immediately if the Tester materially breaches § 8, Service security or third-party rights.
- The Provider may end the Pilot early with at least three days' email notice unless earlier termination is necessary for security, legal or technical reasons.
- The agreement expires at the end of the Pilot subject to § 3(4) and provisions that by their nature survive termination.
§ 14. Changes to the Terms
- The Provider may amend these Terms for valid reasons, including changes to the Service, law, Provider details, Pilot rules or security requirements.
- Material changes will be communicated by email or within the Service with appropriate notice. A Tester who does not accept the change may stop using the Service.
§ 15. Final provisions
- Polish law applies.
- Disputes will be resolved by the court competent under applicable law, taking into account mandatory protections applicable to persons entitled to consumer-like rights.
